Court Fees / Legal Costs to Issue Winding-up Petition

The fees to issue a petition are typically:

  • £332 – Court fee due on presentation of winding-up petition
  • £2,600 – Insolvency Service petition deposit (refundable if the petition is withdrawn or dismissed i.e. the debtor pays) – NB: Increased from £1600 to £2600 from 1 November 2022
  • £2,500 to £5,000 plus VAT – Solicitors fees for a non-complex undefended case
  • £100 plus VAT – Process Server Fees
  • £119.15 plus VAT – London Gazette Advertisement fees

Normally the petitioning creditor can recover these fees from the company and can do so in preference over other creditors. Almost always our specialist winding-up legal counsel team will persuade the court to order (or the other side to agree) to pay towards these petition costs.

When we were first contacted, our client had just obtained a Writ of FiFa and was about to instruct High Court Enforcement Officers (commonly known as Bailiffs).
